Purchase of assets by Kapp Skagans ehf from the bankruptcy estate of Skagans 3X ehf

This decision concerns the acquisition by KAPP Skagans ehf. of assets from the bankruptcy estate of Skagans 3X ehf., with both companies operating, amongst other things, in the market for the manufacture and servicing of equipment for food production. The Competition Authority has no objections to the acquisition. Previously, the Competition Authority had approved the merger parties' request for authorisation to implement the merger, granting an exemption from the prohibition on completing the merger while it is under review. The authority is permitted to grant such an exemption if it is demonstrated that delays in implementing the merger could harm the companies concerned or their business partners, and that competition is at risk. The company's operations then commenced on 1 November 2024, on the basis of the above-mentioned exemption from the Competition Authority.
