The Competition Authority took a position on Landsprent's purchase of a printing press, etc., from the bankruptcy estate of Torg ehf. By purchase agreement, Landsprent bought a printing press and other assets from the bankruptcy estate of Torg. The acquisition would create a monopoly in the domestic market for newspaper printing, as Landsprent has a 100% market share and now owns the country's only newspaper printing press. Under normal circumstances, such a merger or transaction would require intervention from the Competition Authority. However, the merging parties based their case on the condition that the 'company in distress' criterion was met in this instance.
The Competition Authority reviewed the conditions for a failing firm and concluded that the failing firm defence had been established in relation to the acquisition. Consequently, the Competition Authority does not consider it necessary to take further action regarding the merger.
