The Association of Icelandic Wholesalers – FÍS demanded financial separation from Bóksala stúdenta between, on the one hand, sales to the general market and, on the other hand, sales to students. The Competition Authority does not consider that there are legal grounds for intervention in the matter, nor any reason for the institution to become further involved. Although Bóksala stúdenta is considered to enjoy public protection within the meaning of Article 14 of the Competition Act, the legal conditions for applying financial separation are not considered to be met, as under the provisions of the current legislation concerning the Student Welfare Foundation and, by extension, Bóksala stúdenta, the Competition Authority does not consider it possible to distinguish between, on the one hand, services to the universities, i.e. students and staff, and on the other hand, services to the general public. The same applies to a separation between the individual product lines offered for sale. Furthermore, there is no reason to apply Article 16. Article 16 of the Competition Act, as the Act No. 33/1968 on the Student Association of the University of Iceland is a special Act in relation to the Competition Act and therefore there is no legal basis for the application of Article 16(b) of the Competition Act.
