The Competition Appeals Board confirms the decision regarding the merger of Haga hf. and Olíuverzlun Íslands hf.

Samkeppniseftirlitið heimilaði kaup Haga hf. á Olíuverzlun Íslands hf. (Olís) og fasteignafélaginu DGV hf. á grundvelli sáttar við Haga þann 11. september 2018. Samruninn var háður ítarlegum skilyrðum, sem ætlað var að ryðja úr vegi samkeppnishindrunum sem af honum leiddu. Þar á meðal skuldbundu Hagar sig til að selja þrjár dagvöruverslanir Haga, dagvöruhluta verslunar Olís í Stykkishólmi og fimm eldsneytisstöðvar Olís. Ítarlega er fjallað um rannsókn samrunans og þau skilyrði sem sett voru honum í ákvörðun Samkeppniseftirlitsins nr. 9/2019.

Samkaup hf. keppinautur Haga á dagvörumarkaði kærði ákvörðun Samkeppniseftirlitsins til áfrýjunarnefndar samkeppnismála. Samkaup gerðu kröfu um að ákvörðun eftirlitsins yrði felld úr gildi og samruninn ógiltur og varakröfu um að áfrýjunarnefnd myndi ákveða að binda samrunann frekari skilyrðum. Áfrýjunarnefnd samkeppnismála hefur í dag birt úrskurð þar sem kröfum og málsástæðum Samkaupa er hafnað. Tekur áfrýjunarnefnd fram að af gögnum málsins verði ráðið að rannsókn þess hafi verið í fullu samræmi við málsmeðferðarreglur og að Samkeppniseftirlitið hafi við rannsókn málsins framkvæmt umfangsmiklar og ítarlegar rannsóknir og kannanir á undirliggjandi mörkuðum og styrk samrunaaðila.
