Við nýlega athugun Samkeppniseftirlitsins á lyfjamarkaði (sbr. ákvörðun nr. 28/2018) kom í ljós að tiltekin apótek töldu sér, ranglega, óheimilt að veita afslætti af lyfjum sem falla undir greiðsluþátttöku Sjúkratrygginga Íslands.

Vegna framangreinds vill Samkeppniseftirlitið árétta að hvorki lög né reglur koma í veg fyrir að lyfjaverslanir á Íslandi veiti afslætti af lyfjum sem falla undir greiðsluþátttöku Sjúkratrygginga. Þvert á móti er lyfjaverslunum frjálst að veita slíka afslætti sem lið í virkri samkeppni á markaðnum. Hvers konar sameiginleg afstaða keppinauta um takmarkanir á ákvörðunum um afslætti getur farið gegn banni 10. gr. samkeppnislaga nr. 44/2005 við ólögmætu samráði.

Er því eindregið beint til lyfsöluleyfishafa að taka verðlagningu sína til skoðunar með tilliti til þessa. Jafnframt er athygli viðskiptavina apóteka vakin á þessu.

Í samræmi við tilmæli frá Velferðarráðuneytinu breyttu Sjúkratryggingar Íslands framkvæmd við útreikninga á greiðsluþátttöku Sjúkratrygginga í lyfjakostnaði þegar apótek veita afslætti af lyfjum. Tilmælin komu í kjölfar álits Umboðsmanns Alþingis frá 22. desember 2015 í máli nr. 7940/2014. Í álitinu kom fram að Umboðsmaður fengi ekki séð að það leiddi af lyfjalögum að Sjúkratryggingum Íslands væri heimilt að breyta greiðsluþátttökuverði, sem lyfjagreiðslunefnd hefði ákveðið á grundvelli laganna og birt í lyfjaverðskrá, þegar lyfsali veitir afslátt af hlut sjúkratryggðs í smásöluverði. Umboðsmaður taldi því að Velferðarráðuneytið hefði ekki sýnt með ótvíræðum hætti fram á fullnægjandi lagagrundvöll fyrir framkvæmd Sjúkratrygginga Íslands. Umboðsmaður mæltist til þess við heilbrigðisráðherra að gerðar yrðu breytingar á þessari framkvæmd þannig að hún samrýmdist gildandi lögum. Væri það afstaða stjórnvalda að aðferðin sem væri viðhöfð væri æskileg þyrfti að leita eftir viðbrögðum Alþingis við lagabreytingum þar um.

Þann 21. mars 2016 sendi Velferðarráðuneytið tilmæli til Sjúkratrygginga Íslands. Í bréfinu var því beint til Sjúkratrygginga að láta af þeirri framkvæmd sem hefði verið viðhöfð við útreikninga þegar afsláttur væri veittur í lyfjabúðum. Sjúkratryggingar brugðust við þeim tilmælum og auglýstu breytt verklag á heimasíðu sinni, líkt og áður sagði, 31. mars 2016.
