The European Commission recently published draft guidelines on the application of Article 102 of the TFEU. The provision is identical to Article 11 of the Competition Act, which prohibits all abuse of a dominant position. The draft guidelines seek to increase legal certainty and enhance consistency in the application of the provision.
The Competition Authority is an active participant in the cooperation of European competition authorities, through the European Competition Network (ECN). The Competition Authority and the ECN support this initiative and encourage those interested in submitting comments or views on the draft guidelines to do so via the Commission's website.
