Supreme Court grants the Competition Authority permission to appeal

Þann 14. júní 2019 staðfesti Landsréttur að Byko hefði framið alvarleg brot á samkeppnislögum. Áfrýjunarnefnd samkeppnismála hafði talið 65 mkr. sekt hæfilega en Héraðsdómur Reykjavíkur hafði hækkað sekt Byko í 400 mkr. Landsréttur komst að þeirri niðurstöðu að sekt Byko skyldi vera 325 mkr.

Landsréttur taldi að þegar brot Byko á samkeppnislögum væru „metin heildstætt [verði] að leggja til grundvallar að um sé að ræða alvarleg brot sem beinast gegn mikilsverðum hagsmunum neytenda. Brotin voru framin af ásetningi.“ Lækkun Landsréttar á þeirri sekt sem ákveðin var í héraði byggði m.a. á því að Landsréttur féllst ekki á það með Samkeppniseftirlitinu að Byko hefði einnig brotið gegn EES-samningnum.

Samkeppniseftirlitið telur að Landsréttur hafi ekki beitt banni EES samningsins við samkeppnishamlandi samráði með réttum hætti. Þá telur eftirlitið að sú sekt sem Landsréttur taldi hæfilega byggi á röngum forsendum og tryggi ekki nægjanleg varnaðaráhrif. Sökum þessa óskaði Samkeppniseftirlitið eftir leyfi Hæstaréttar til að áfrýja dómi Landsréttar. Hefur Hæstiréttur nú samþykkt þá beiðni Samkeppniseftirlitsins. Sjá hér:

Aðdragandi málsins er sá að í maí 2015 komst Samkeppniseftirlitið að þeirri niðurstöðu að Byko hefði brotið gegn samkeppnislögum og EES-samningnum með umfangsmiklu ólögmætu samráði við gömlu Húsasmiðjuna. Var um að ræða verðsamráð á mikilvægum byggingavörum. Málið hófst þegar Múrbúðin snéri sér til Samkeppniseftirlitsins og gerði grein fyrir tilraunum Byko og gömlu Húsasmiðjunnar til að fá Múrbúðina til að taka þátt í hinu ólögmæta samráði. Taldi Samkeppniseftirlitið að um alvarleg brot væri að ræða og lagði 650 mkr. sekt á Norvik, móðurfélag Byko.

Norvik and Byko appealed the decision of the Competition Authority to the Competition Appeals Board. In October 2015, the board concluded that Byko had participated in illegal price-fixing and breached competition law. However, the panel did not agree that the provisions of the EEA Agreement had been breached. The panel also considered that Byko's infringement was not as serious as the Competition Authority had found. The panel therefore considered it appropriate to reduce Byko's fine from 650 million krónur to 65 million krónur. The District Court, however, considered the offences to be much more serious and increased Byko's fine at the request of the Competition Authority. The district court also agreed with the Authority that Byko had breached the EEA Agreement's prohibition on anti-competitive collusion.
