The Competition Appeals Board upheld the Competition Authority's decision to refuse to investigate the complaint from Og fjarskipti. Og fjarskipti had requested that the Competition Authority investigate the alleged abuse of a dominant position by Síminn hf. in the market for ADSL connections, as they considered that Síminn hf. discriminating against the company in the handling of requests for access to telephone lines and, furthermore, that the company was being discriminated against in its pricing. The Competition Authority considered that the complaint did not meet the requirements of the authority's procedural rules but forwarded it to the Post and Telecommunications Authority. The Appeals Board considered that the Competition Authority had fulfilled its duties under competition and administrative law, and therefore did not agree to the requirement of Og Fjarskipta for the case to be referred back to the Competition Authority for processing.
