
By decision of the Competition Authority No. 43/2007 Sund ehf. was found to have breached its obligation to comply with the authority's request for information. Pursuant to the provision of Article 37 of the Competition Act, the Competition Authority imposes a fine on companies that breach the obligation to provide information, and Sund was therefore fined one million krónur. By a ruling of the Competition Appeals Board No. 7/2007 On 8 October 2007, the decision of the Competition Authority was confirmed.
Sund ehf. appealed the decision of the Appeal Board of Competition to the Reykjavík District Court, seeking its annulment. In the District Court's judgment of 27 June 2008 in the case No. E-7507/2007 it was concluded that the Competition Authority's decision had an insufficient description of the infringement that Sund was alleged to have committed. The court's conclusion was based on the fact that it was not sufficient to establish a breach of Article 19 of the Competition Act on the basis that information had not been provided within a deadline when it was unclear which deadline was in question. The district court therefore set aside the decision of the Competition Appeals Board.
