
In February 2012 confirm then the Competition Appeal Tribunal conclusion The Competition Authority found that the meat processing companies Síld og fiskur ehf. and Matfugl ehf. had breached the competition law prohibition on illegal collusion by having close cooperation with Bónus regarding its retail prices and discounts. The decision that it was right to impose a fine on Langasjó ehf. for these infringements was also upheld. Síld og fiskur and Matfugl are 100% owned by Langasjó, which is therefore their parent company. In competition law, a parent and subsidiary company are, as a rule, regarded as a single undertaking.
Í judgement The District Court of Reykjavík has today ruled that it was not permissible to impose a fine on Langasjó. It would have been more appropriate to impose it on the subsidiaries. The ruling of the appeals board was therefore overturned.
The Competition Authority disagrees with the district court's legal interpretation and reasoning and will therefore appeal the case to the Supreme Court.
