
The Competition Authority is currently finalising a so-called preliminary assessment report on the fuel market, which is part of an ongoing market investigation into the fuel market. The investigation involves examining whether action needs to be taken against conditions or conduct that prevent, restrict or have a detrimental effect on competition, to the detriment of the public. The investigation is based on Article 16(1)(c) of the Competition Act, as also referred to in the rules No. 490/2013 on the market research of the Competition Authority.
The publication of the aforementioned preliminary assessment report is now scheduled for the end of next September. The publication of the report is therefore delayed by up to three months from the date that had been announced on the Competition Authority's website (hereThese delays are mainly due to more extensive data processing than the previous schedule had anticipated.
The preliminary assessment report will contain a draft of the market investigation's findings in accordance with Article 8 of the aforementioned Regulation No 490/2013. Subsequently, the parties to the case, and any others who so request, will be given a reasonable period to make written observations on the preliminary assessment report. The Competition Authority will organise a public meeting where interested parties and others will have the opportunity to familiarise themselves with the report and submit their views on the draft assessment report.
Following the above process, the Competition Authority will assess whether it is necessary to intervene in the market pursuant to c-item of paragraph 1 of Article 16 of the Competition Act.
