Measures to strengthen competition in the commercial banking market – Settlement with Arion Bank

By decision of the Competition Authority No. 24/2017, sem birt er í dag, er gerð grein fyrir sátt sem eftirlitið hefur gert við Arion banka um aðgerðir til þess að efla samkeppni í viðskiptabankaþjónustu. Þær aðgerðir sem kveðið er á um í sáttinni miða einkum að því að:

  1. 1. Reduce the costs incurred by customers when switching banks.
  2. 2. Promote more effective competition from individuals and small businesses with those providing commercial banking services in Iceland.
  3. 3. To work against situations that could undermine tacit coordination in the market/markets for commercial banking services.

Aðgerðirnar sem Arion banki tekst á hendur með sáttinni eru í öllum meginatriðum hliðstæðar þeim aðgerðum sem kveðið er á um í sátt Samkeppniseftirlitsins við Landsbankann – News . Viðræður við Íslandsbanka um sama efni eru á lokastigi.

Páll Gunnar Pálsson, forstjóri Samkeppniseftirlitsins: „Með því að draga úr hindrunum fyrir viðskiptavini við að skipta um banka geta viðskiptavinir veitt bönkunum meira aðhald sem ætti m.a. að hafa það í för með sér að bankarnir þurfi að keppa meira um viðskiptavini, þ.m.t. bjóða þeim betri kjör og þjónustu til að halda í þá.“

Nánar um sáttina:

With the settlement, Arion Bank specifically commits to following the following conditions in its operations:

  • Uppgreiðslugjöld verða ekki lögð á umframgreiðslur skuldara inn á nein ný og útistandandi lán einstaklinga og lítilla fyrirtækja sem bera breytilega vexti, óháð því undir hvaða lögum viðkomandi lán voru upphaflega veitt. 
  • Hámörk eru innleidd á þóknanir við flutning bundins séreignalífeyrissparnaðar frá bankanum til annarra aðila sem bjóða upp á stýringu séreignalífeyrissparnaðar. Er þetta einkum til þess fallið að draga úr bindandi áhrifum slíkra gjalda á hreyfanleika viðskiptavina og stuðla þannig að virkara samkeppnisaðhaldi á þessu sviði. 
  • The assumption of a mortgage in a property transaction will not be conditional on the buyer moving their banking business to the bank. By 'banking business', we mean a current account and, where applicable, other concurrent business.
  • Viðskiptavinum verður auðveldað að færa bankaviðskipti sín milli banka. Val, þróun og innleiðing kerfa og tæknilegra úrlausna mun miða að þessu og þjónustukannanir nýttar til að bera kennsl á áherslur viðskiptavina í tengslum við þetta og mun bankinn bregðast við þeim. 
  • Viðskiptavinir verða upplýstir sérstaklega um verulegar breytingar á vöxtum og verðskrá áður en þær eiga sér stað, til að gefa viðskiptavinum svigrúm til þess að færa viðskipti sín ef þeir svo kjósa. 
  • Bankinn mun búa svo um hnútana að allar upplýsingar um almennar þóknanir, kjör og skilmála, sem eru opinberlega birtar á vefsíðu bankans, verði aðgengilegar gegnum opið API viðmót (upplýsingatæknigátt fyrir sérsniðnar forritunarlausnir)  sem þriðju aðilar (einstaklingar, fyrirtæki eða félagasamtök) gætu sótt og nýtt til að setja upp samanburðarvefsíðu sem virkjað gæti skilvirkara neytendaaðhald.[1] Getur þetta jafnframt falið í sér ákveðin viðskiptatækifæri fyrir fyrirtæki sem áhuga hafa á að hasla sér völl á sviði fjármálatækni (e. FinTech) hérlendis.
  • Tiltekin heimildarákvæði í skilmálum íbúðalána sem fela í sér verulega bindingu að mati Samkeppniseftirlitsins, og upphaflega urðu tilefni rannsóknar af hálfu Samkeppniseftirlitsins, verða ekki virkjuð af bankanum.  

Sú sátt sem hér er kynnt felur jafnframt í sér innlegg í stefnumörkun sem stjórnvöld og bankarnir standa nú frammi fyrir á fjármálamarkaði í tengslum við breytingar á eignarhaldi bankanna og öra þróun í fjármálaþjónustu á alþjóðavettvangi.
