Delays in the processing of cases – prioritisation

Vegnamikilla anna við rannsókn samrunamála hafa orðið tafir á meðferð annarra mála hjá Samkeppniseftirlitinu. Fyrirsjáanlegt er að áframhaldandi tafir á málsmeðferð verði vegna þessa á næstunni.

Tilkynningar um samruna fyrirtækja voru um tvöfalt fleiri á fyrri helmingi þessa árs, en á sama tímabili árin 2015 og 2016. Að auki er í mörgum tilvikum um að ræða samruna fyrirtækja á mörkuðum sem skipta miklu máli fyrir almenning og efnahagslífið. Þannig hafa verið eða munu verða til rannsóknar samrunar sem varða dagvörumarkað, lyfjamarkað, fjölmiðlamarkað, fjarskiptamarkað og eldsneytismarkað, svo eitthvað sé nefnt.

Samkvæmt lögum verður Samkeppniseftirlitið að taka afstöðu til samrunamála innan tiltekins frests sem byrjar að líða þegar fullbúin samrunatilkynning hefur borist eftirlitinu. Eftir að fresturinn er liðinn getur eftirlitið ekki gripið til íhlutunar í samrunann. Af þessu leiðir að Samkeppniseftirlitið verður ávallt að raða samrunamálum fremst í forgangsröð, á kostnað annarra mála.

Endurskoðun forgangsröðunar

Samkeppniseftirlitið hyggst taka tilefni til rannsókna og forgangsröðun annarra mála en samrunamála til endurskoðunar í ágúst og september næstkomandi. Samkeppnislög veita Samkeppniseftirlitinu heimildir til að meta hvort tilefni sé til rannsóknar mála sem berast eftirlitinu og raða málum í forgangsröð, sbr. nánar 3. mgr. 8. gr. laga nr. 44/2005. Vegna yfirstandandi anna kann að koma til þess að meðferð einstakra mála verði frestað enn frekar eða meðferð þeirra felld niður.

Stefnt er að því að meðferð mála verði komin í eðlilegt horf síðar í haust, eða þegar dregur úr önnum vegna stærri samrunamála.

Ábendingar

Þeim sem hyggjast senda Samkeppniseftirlitinu ný erindi vegna mögulegra brota á samkeppnislögum er bent á að þeir hafa þann valkost að senda ábendingu fremur en fullbúið erindi. Á grundvelli slíkrar ábendingar geta viðkomandi síðan leitað frekari upplýsinga um hvort líkur séu á að erindi vegna málsins verði tekið til meðferðar og þá hvenær.
