In merger control and in the enforcement of Icelandic competition law, the Competition Authority takes into account the guidelines of the European Commission, both the guidelines on horizontal mergers and the guidelines on vertical and conglomerate mergers. The guidelines can also be used in the implementation of the EEA Agreement.
The EU Commission has now launched a public consultation on the revision of its merger guidelines.
All stakeholders and other interested parties can submit both general views and respond to a detailed questionnaire on the Commission's website. Individuals and companies can thus influence the Commission's work in updating and revising its guidelines, and thereby potentially affect future merger investigation procedures, both abroad and at home.
According to the EU Executive, its work will focus on innovation, efficiency, resilience, timelines, investment in specific areas, sustainability, and changes in security and defence matters. Specifically, the emphasis will be on reviewing the weight to be given to these factors in the assessment of merger effects.
Further information is available here on the website of the European Commission – including how to submit viewpoints if parties wish to participate.
