The Competition Authority grants a conditional exemption for the cooperation of technicians working on the network and information security of financial undertakings.

Samkeppniseftirlitið hefur í dag birt ákvörðun (nr. 34/2016) þar sem tekin er afstaða til beiðni frá Samtökum fjármálafyrirtækja (hér eftir „SFF“) um undanþágu samkvæmt 15. gr. samkeppnislaga nr. 44/2005 vegna samstarfs tæknimanna sem starfa að net- og upplýsingaöryggismálum fjármálafyrirtækja. Var beiðnin sett fram fyrir hönd allra aðildarfélaga SFF. Að undangenginni gagnaöflun og að fengnum sjónarmiðum frá m.a. erindisbeiðendum, Fjármálaeftirlitinu (hér eftir „FME“), Seðlabanka Íslands og Póst- og fjarskiptastofnun (hér eftir „PFS“) fellst Samkeppniseftirlitið á framangreinda ósk um undanþágu fyrir fjármálafyrirtæki frá banni við samráði.

Heimild til samstarfs tekur til þeirra fjármálafyrirtækja sem starfsleyfi hafa frá FME samkvæmt lögum um fjármálafyrirtæki nr. 161/2002 eða lögum um vátryggingastarfsemi nr. 100/2016. Er heimildin þannig ekki bundin aðild fyrirtækja að SFF. Samkeppniseftirlitið setur undanþágunni tiltekin skilyrði sem koma eiga í veg fyrir að samkeppni verði takmörkuð með samstarfinu. Með undanþágunni er fallist á mikilvægi þess að fjármálafyrirtæki standi sameiginlega að tilteknum viðbúnaði gagnvart netárásum, auðkennisstuldi og öðrum tölvuglæpum, sem ógnað geta fjármálafyrirtækjum og/eða viðskiptavinum þeirra.
