Court of Appeal confirms the annulment of a merger in the diagnostic imaging services market

The High Court's judgment today upheld the annulment
The Competition Authority's merger review of Íslenskrar myndgreiningar ehf. and
Læknisfræðilegrar myndgreiningar ehf. The judgment thus confirms a ruling
of the Reykjavík District Court from 2022. Previously, the Competition Appeals Board
confirmation of the decision of the Competition Authority, pursuant to its decision No. 35/2020.

The activity of merger partners consists of providing medical
imaging services, which include, for example, computed tomography scans,
X-ray examinations, ultrasound, MRI and CT scans. The activity has a high
significance for healthcare services in the country. Competitive disruption in this area
may be liable to reduce quality and increase the cost of
healthcare services.

With the merger, the number of competitors in the market would have been reduced from three to
two and the combined market share of the merger partners has become between 80-100%, after
which service elements are concerned.
