Recommendations of the Competition Authority regarding the City of Reykjavík's contractual objectives and negotiations with the oil companies – a 50% reduction in petrol stations

Samkeppniseftirlitið sendi Reykjavíkurborg bréf hinn 17. júlí sl. með tilmælum vegna samningsmarkmiða borgarinnar um fækkun bensínstöðva í sveitarfélaginu og mögulegra áhrifa aðgerðanna á samkeppni. Hér er vísað til þess að hinn 9. maí 2019 samþykkti borgarráð tillögu borgarstjóra um samningsmarkmið vegna væntanlegra viðræðna borgarinnar við rekstraraðila og lóðarhafa bensínstöðvarlóða í Reykjavík, þess efnis að fækka skuli bensínstöðvum í sveitarfélaginu um helming. Í greinargerð með hinni samþykktu tillögu, dags. 7. maí 2019, er að finna nánari útfærslu á framangreindum markmiðum.

Í bréfi Samkeppniseftirlitsins til borgarinnar eru annars vegar áréttuð fyrri tilmæli eftirlitsins til Reykjavíkurborgar frá 4. apríl 2017, sjá nánar álit Samkeppniseftirlitsins nr. 2/2017, Samkeppnishömlur á eldsneytismarkaði – Álit til Reykjavíkurborgar vegna skipulagsmála. Þar var m.a. komist að þeirri niðurstöðu að stefna borgarinnar undanfarin ár hefði í senn hindrað starfsemi nýrra og smærri keppinauta á markaðnum og að líkindum leitt til þess að starfandi félög héldu að sér höndum við hagræðingu og lokun stöðva. Í álitinu var tilmælum beint til borgarinnar vegna þessa.

Hins vegar var í bréfinu tekið undir að fjöldi eldsneytisstöðva í borginni væri umtalsverður, en lögð áhersla á mikilvægi þess að aðgerðir borgarinnar við fækkun eldsneytisstöðva væru úrfærðar á þann hátt að þær hefðu ekki skaðleg áhrif á samkeppni. Því væri mikilvægt að borgin legði mat á áhrif nýrra samningsmarkmiða á samkeppni á eldsneytismarkaði. Lagði Samkeppniseftirlitið til aðferðafræði við það mat, með vísan til álits nr. 2/2009, Government assessment of competition.
